Welcome to Nephin.ie. Please read these Terms and Conditions carefully before using our services as they affect your obligations and legal rights, including, but not limited to, waivers of rights and limitation of liability. By accessing or using the services provided by Nephin Physiotherapy Clinic (hereinafter referred to as “Nephin.ie”), you agree to be bound by these Terms.

1. General

These Terms govern the use of the Nephin.ie website and all associated services provided by Nephin Physiotherapy Clinic. The services include but are not limited to, physiotherapy consultation and treatment, online appointment bookings, and physiotherapy advice.

2. Services

Nephin.ie provides physiotherapy services subject to appointment availability. Services must be booked in advance through our website.

3. Eligibility

To book an appointment by yourself, you must be at least 18 years old. All patients under 18 years of age need to be accompanied by an adult for their appointment. By agreeing to these Terms, you represent and warrant that you are of legal age and that your use of Nephin.ie does not violate any applicable law or regulation.

4. User Responsibilities

You agree to provide accurate and current information about yourself as required during the service registration process. You agree to update such information promptly, and as necessary to keep it current and accurate.

5. Privacy Policy

Our Privacy Policy, which sets out how we will use your information, can be accessed here. By using this service, you consent to the processing described therein and warrant that all data provided by you is accurate.

6. Cancellations and Refunds

Appointments must be cancelled at least 24 hours in advance. Late cancellations or missed appointments will incur a fee as specified on our website. Refunds for services already performed are not offered.

7. Intellectual Property

The content on Nephin.ie, including text, graphics, logos, images, and all other material, is the property of Nephin Physiotherapy Clinic and is protected by copyright and other intellectual property laws.

8. Limitation of Liability

Nephin.ie will not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification

You agree to defend, indemnify, and hold harmless Nephin.ie and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the service.

10. Changes

We reserve the right to modify or replace these Terms at any time at our discretion. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
