Rental Agreement between Nephin T/A Nephin.ie and Nephin Wellness
Nephin T/A Nephin.ie (hereinafter “the Company”) agrees to hire Game Ready products to Nephin Wellness (hereinafter “the Hirer”) on the terms and conditions set out below. No alternative terms that conflict with these conditions shall be binding on the Company.
1. Hirer’s obligations
The Hirer, or any medical professional authorised to order on the Hirer’s behalf, must supply all information requested on the rental form (or otherwise in writing) before the rental period begins.
2. Payment
Full payment is due prior to despatch unless the Company agrees otherwise in writing. Valid credit-card details must be provided for the whole rental period. The Hirer authorises the Company to charge that card for any additional sums that fall due.
3. Rental period
The rental period starts on the day of delivery. At least 48 hours before the agreed collection date the Hirer must contact the Company to confirm collection.
4. Ownership
All hired goods remain the property of the Company at all times.
5. Insurance, loss and damage
From delivery until the equipment is collected by DPD for return, the Hirer is responsible for any loss, theft or damage. The Hirer must insure the goods for their full retail replacement value for the entire rental period. The Hirer is liable for all repair costs caused by misuse or by inadequate repackaging or labelling; if repair is impossible, the Hirer must pay the retail replacement cost of the item(s). The Company will notify the Hirer of any such costs in writing.
6. Delivery
The Company is not liable for any delivery delay. All deliveries and collections will be made via the Company’s nominated courier; additional charges may apply for special services (e.g. Saturday delivery) or for missed collections.
7. Adjustment of hire dates
If delivery is delayed, the hire and collection dates will shift accordingly. No refund is given for an early return unless the Company agrees in writing.
8. Extending the hire
To extend the rental period, the Hirer must notify the Company in writing at least 48 hours before the scheduled collection. Extension fees will be charged to the card on file when the request is made.
9. Collection procedure
No later than 48 hours before collection, the Hirer must email info@nephin.ie confirming the collection address so the Company can book the courier. Failure to do so incurs a €50 late-return fee if the goods are collected or returned within 24 hours of the scheduled date.
10. Late-return charges
If the equipment has still not been collected or returned 48 hours after the scheduled date, a charge of €100 will apply for any period of up to seven days thereafter.
11. Clinical use
Any clinical information supplied by the Company is general guidance only and is not a substitute for professional medical advice. The Hirer must consult a registered medical professional regarding suitability and correct application before use.
12. Liability
The Company accepts no responsibility for any incident, injury or indirect or consequential loss arising from negligent or incorrect use of the equipment.
13. Indemnity
The Hirer agrees to indemnify and hold harmless the Company against all claims, damages, costs and legal fees arising out of improper use or care of the equipment during the rental period.
14. Privacy
The Company will not intentionally disclose any personal information supplied by the Hirer to unauthorised third parties without the Hirer’s express consent.
